The standard Terms & Conditions that apply to all BambooSIM services.

These Terms of Service ("Terms") constitute a legally binding agreement between BambooSIM Pty. Ltd. ("BambooSIM," "we," "us," or "our") and you ("you" or "your"). By using BambooSIM services, you agree to comply with these Terms. Please read them carefully.
1. Acceptance of Terms
1.1 Agreement
By accessing or using BambooSIM’s services, you accept and agree to these Terms of Service, our Privacy Policy, and Acceptable Use Policy (AUP).
1.2 Eligibility
You confirm that:
- You are legally capable of entering into binding agreements.
- You are authorised to act on behalf of any entity you represent.
- Your use of the services complies with all applicable laws.
1.3 Consent to Jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia, and any disputes must be resolved in its courts.
2. Account Registration and Responsibilities
2.1 Account Creation
To access services, you must create an account by providing accurate and current information. You are responsible for maintaining the security of your account credentials.
2.2 Account Activities
You are responsible for all activities associated with your account, including:
- Data usage by you or authorised users.
- Compliance with these Terms by all individuals or entities using your account.
2.3 Account Information
You must keep your contact and billing details up to date. Failure to do so may result in service interruptions.
2.4 Resale Prohibition
Reselling BambooSIM services is strictly prohibited unless explicitly authorised in writing by BambooSIM.
3. Services and Usage
3.1 Service Overview
BambooSIM provides prepaid eSIM plans for global data connectivity. Plans are subject to network availability and conditions.
3.2 Licence
BambooSIM grants you a limited, non-transferable licence to use its services solely for your personal or business purposes.
3.3 Data Plans
- Prepayment: All plans must be prepaid. Unused data cannot be carried over or refunded unless explicitly stated.
- Daily Data Limits: For plans with daily limits, unused high-speed data does not roll over.
- Speed and Coverage: Network speeds and availability depend on local roaming networks and cannot be guaranteed.
3.4 Support
Standard technical support is available for service-related issues. BambooSIM reserves the right to modify support availability at its discretion.
4. Privacy and Data Protection
4.1 Privacy Compliance
BambooSIM complies with Australian privacy laws. Our data collection, use, and protection practices are detailed in the Privacy Policy.
4.2 Data Processing
- BambooSIM processes your data as necessary to provide services.
- You authorise us to use third-party service providers to support our operations.
4.3 Data Security
BambooSIM implements reasonable measures to protect your data from unauthorised access or loss. You are responsible for safeguarding your account access credentials.
5. Billing, Payments, and Refunds
5.1 Payments
- All payments must be made in advance.
- Auto-renewing plans will charge your payment method unless cancelled in advance.
5.2 Currency and Fees
Payments in currencies other than AUD may be subject to foreign exchange fees. You are responsible for any additional fees charged by your bank or payment provider.
5.3 Refunds
Refunds may be available at our discretion if no data has been used and if requested within 30 days of purchase.
5.4 Changes in Fees
BambooSIM reserves the right to adjust pricing with 30 days' notice for existing plans or immediately for new purchases.
6. Third-Party Content and Tools
6.1 Third-Party Content
BambooSIM is not responsible for third-party content or tools you may use with the services. Use of such content is at your own risk.
6.2 Prohibited Tools
BambooSIM may prohibit the use of certain third-party tools or content at its sole discretion.
7. Intellectual Property
7.1 Ownership
All intellectual property related to BambooSIM services, including trademarks, logos, and software, remains the exclusive property of BambooSIM.
7.2 Usage Rights
You may not modify, reverse engineer, distribute, or sublicense any part of the services without BambooSIM's prior written consent.
7.3 Feedback
Any suggestions or feedback you provide to BambooSIM may be used by us for any purpose without obligation to you.
8. Limitations of Liability and Warranties
8.1 Disclaimer
BambooSIM provides services "as is" and "as available." We do not guarantee uninterrupted or error-free service.
8.2 Liability Cap
BambooSIM’s liability is limited to the total fees paid by you in the 12 months preceding any claim.
8.3 Exclusions
BambooSIM is not liable for indirect, incidental, or consequential damages, including data loss or business interruption.
9. Dispute Resolution
9.1 Resolution Process
All disputes must first be addressed through good faith negotiations. If unresolved, disputes will be subject to arbitration or resolved in the courts of Victoria, Australia.
9.2 Class Action Waiver
You waive the right to participate in class actions or collective legal proceedings against BambooSIM.
10. Suspension and Termination
10.1 Suspension of Services
BambooSIM may suspend services if:
- Payments are overdue.
- Your account is used in violation of these Terms.
- Required by law or court order.
10.2 Termination
- Either party may terminate this agreement with notice if the other party breaches its obligations.
- Upon termination, all rights to use the services cease, and BambooSIM may delete your account data.
11. Force Majeure
BambooSIM is not liable for service interruptions caused by events beyond its reasonable control, including natural disasters, government actions, or technical failures.
12. Miscellaneous
12.1 Independent Contractors
BambooSIM and you are independent parties. These Terms do not create any partnership, agency, or employment relationship.
12.2 Assignment
You may not assign these Terms without BambooSIM’s written consent.
12.3 Severability
If any provision of these Terms is found to be invalid, the remaining provisions remain in full force.
12.4 Entire Agreement
These Terms, along with the Privacy Policy and AUP, represent the entire agreement between you and BambooSIM.
Definitions
- Account: Your registered BambooSIM user account.
- Covered User: Any individual or entity authorised to use your account or the services.
- Services: BambooSIM’s eSIM and global data services.
- Third-Party Content: Any tools, applications, or content not owned by BambooSIM.
